(1) A foreign investor may make a foreign investment in any industry and receive benefits from such investment.
(2) Notwithstanding anything contained in sub-section (1), no foreign investment shall be made in the industries mentioned in the Schedule, either out of profits earned or in any other way, by an industry operated by foreign investment. However, the technology can be transferred with the approval of the department in the industries established with Nepali investment mentioned in the schedule.
(3) Notwithstanding anything written in sub-section (1), no approval shall be given for foreign investment in any industry of less than the amount specified by the Government of Nepal by publishing a notice in the Nepal Gazette.
